The First Amendment to the United States Constitution robustly protects freedom of religion and speech for individuals of all faiths, including those holding traditional evangelical views that emphasize strict adherenceto biblical principles—often perceived as legalistic or even hateful by modern standards.
This protection ensures that believers can freely exercise their sincerely held doctrines, such as opposition to certain behaviors on moral grounds, without government censorship or punishment, as affirmed in landmark Supreme Court cases like West Virginia State Board of Education v. Barnette (1943), which upheld the right to dissent from prevailing norms, & Masterpiece Cakeshop v. Colorado Civil Rights Commission (2018), which safeguarded religious expression against hostile state action.
Even when such views clash with contemporary societal values, the Amendment prioritizes viewpoint neutrality, preventing the majority from silencing minority faiths and fostering a pluralistic society where unpopular beliefs are shielded from suppression.
The Religious Freedom Restoration Act (40 U.S.C. 2000bb-1 et seq., “RFRA”) was enacted by Congress in 1993 “in order to provide very broad protection for religious liberty.” Burwell v. Hobby Lobby Stores, Inc., 573 U.S. 682 at 693 (2014). It was enacted in response to the Supreme Court’s decision in Employment Div., Dept. of Human Resources of Ore. v. Smith, 494 U.S. 872 (1990) by Congress in an attempt to restore what Congress felt was the proper respect for the freedom to exercise one’s religion in America. Through this act, Congress explicitly attempted to adopt by statute the balancing test that existed prior to Smith, as delineated in prior Supreme Court precedent under Sherbert v.
